Welcome to Poke Dreams! These Terms of Service ("Terms") govern your use of our website and your purchase of our products. By using our site or placing an order, you agree to these Terms.
About Poke Dreams
Poke Dreams creates custom fan-art trading cards inspired by pop culture, gaming, and collectible aesthetics. We are a small, independently-run business.
Fan Art & Intellectual Property Disclaimer
Poke Dreams is an independent fan art project. We are not affiliated with, endorsed by, or sponsored by Nintendo, Game Freak, Creatures Inc., The Pokémon Company, Sanrio, or any other holders of trademarks or characters that may inspire our fan art. All such trademarks and characters belong to their respective owners. Our original artwork, designs, and card layouts are the property of Poke Dreams and may not be reproduced or resold without permission.
Orders & Payment
- All orders are subject to acceptance and product availability.
- Prices are listed in USD and may change without notice.
- Payment is processed securely through our third-party payment processor at checkout.
Custom / Commissioned Orders
Custom card commissions may involve a design approval step before production begins. Once you approve a design and production starts, the order is generally final and non-refundable, except as described under Returns & Refunds below. (Drew — confirm this matches how you actually want to handle commissions, and we'll adjust the wording.)
Shipping
We aim to process and ship orders within our stated timeframe (see FAQ & Shipping page). Risk of loss and title for items transfers to you upon delivery to the shipping carrier. We are not responsible for delays caused by the carrier.
Returns & Refunds
Because many of our products are made-to-order or produced in limited quantities, all sales are generally final. If an item arrives damaged or defective, contact us within 7 days of delivery and we'll make it right. (Drew — adjust this to your real policy; this is a placeholder default.)
SMS & Email Marketing
By opting in to drop alerts or promotional texts/emails, you consent to receive marketing messages from us. See our Privacy Policy for full details on SMS terms, opt-out instructions, and message/data rate disclosures.
User Conduct
You agree not to misuse our site, attempt unauthorized access to our systems, or use our content for commercial purposes without permission.
Limitation of Liability
To the fullest extent permitted by law, Poke Dreams is not liable for indirect, incidental, or consequential damages arising from your use of our site or products. Our total liability for any claim is limited to the amount you paid for the product in question.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Changes to These Terms
We may update these Terms from time to time. Continued use of our site after changes means you accept the updated Terms.
